Lead101 is a brand owned and operated by TECTRA SERVE PRIVATE LIMITED ("Company"). By accessing and using the Lead101 platform ("Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

These Terms and Conditions ("Terms") govern your access to and use of our platform, services, and software. By creating an account or using our services, you agree to comply with and be bound by these Terms.

The Platform and related services are provided by TECTRA SERVE PRIVATE LIMITED, operating under the brand name Lead101.

2. Third-Party Advertising Platform Integration and Consent

By using our Platform, you acknowledge and consent to our integration with third-party advertising and marketing platforms, including but not limited to Meta (Facebook), LinkedIn, and Google Ads. Your use of our services constitutes your acceptance and approval of the following:

2.1 Meta (Facebook) Integration

Our Platform may integrate with Meta's advertising services, including Facebook Ads and Instagram Ads. By using our services, you consent to:

• The collection, processing, and sharing of data with Meta for advertising and marketing purposes
• The use of Meta's tracking technologies, including pixels and cookies, to measure and optimize advertising campaigns
• The display of personalized advertisements based on your interactions with our Platform
• Compliance with Meta's Terms of Service and Advertising Policies

You acknowledge that Meta may use your data in accordance with Meta's Data Policy, which can be found at https://www.facebook.com/privacy/policy.

2.2 LinkedIn Integration

Our Platform may integrate with LinkedIn's advertising and marketing services. By using our services, you consent to:

• The collection, processing, and sharing of data with LinkedIn for advertising and marketing purposes
• The use of LinkedIn's tracking technologies, including Insight Tag and cookies, to measure and optimize advertising campaigns
• The display of targeted advertisements based on your professional profile and interactions
• Compliance with LinkedIn's Terms of Service and Advertising Policies

You acknowledge that LinkedIn may use your data in accordance with LinkedIn's Privacy Policy, which can be found at https://www.linkedin.com/legal/privacy-policy.

2.3 Google Ads Integration

Our Platform may integrate with Google Ads and related Google advertising services. By using our services, you consent to:

• The collection, processing, and sharing of data with Google for advertising and marketing purposes
• The use of Google's tracking technologies, including Google Analytics, conversion tracking, and remarketing tags
• The display of personalized advertisements across Google's advertising network
• Compliance with Google's Terms of Service and Advertising Policies

2.4 WhatsApp Business Integration

Our Platform may use the WhatsApp Business Platform (WhatsApp Business API) to enable you to send and receive messages with your customers. By using WhatsApp messaging features through our Platform, you agree to:

• Comply with the WhatsApp Business Terms of Service and the WhatsApp Business Messaging Policy
• Obtain opt-in permission from recipients before sending them messages or calls, and maintain records of consent as required by WhatsApp and applicable law
• Provide clear escalation paths (e.g. support form, email, phone, in-chat human agent) so that users can get help or opt out
• Not use WhatsApp to forward or share information from one customer's chat with another customer, or use WhatsApp-derived data for purposes other than supporting messaging with that person

Use of WhatsApp Business Services is also subject to the WhatsApp Messaging Guidelines. We are not responsible for WhatsApp's or Meta's services or policies; your use of WhatsApp is at your own risk.

2.5 General Provisions for Third-Party Platforms

By accepting these Terms, you explicitly approve and consent to:

• The use of your data by Meta, LinkedIn, Google Ads, and WhatsApp (where applicable) for advertising, analytics, marketing, or messaging purposes as described in these Terms
• Cross-platform data sharing necessary for advertising campaign optimization and measurement
• The placement of tracking pixels, cookies, and similar technologies on your devices
• Receiving targeted advertisements based on your interactions with our Platform and these third-party services

You understand that these third-party platforms operate independently and have their own terms of service and privacy policies. We are not responsible for the privacy practices or content of these third-party platforms.

If you do not consent to the use of your data by these third-party advertising platforms, you may opt out through your account settings or by discontinuing use of our Platform. However, certain features of our Platform may require these integrations to function properly.

3. Service Description

Lead101 provides a comprehensive customer relationship management solution designed for educational institutions. Our services include:

• Lead management and tracking
• Form builder and application management
• Payment processing and fee management
• Document verification and approval workflows
• Analytics and reporting
• Integration with third-party services

4. User Obligations

4.1 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

4.2 Acceptable Use

You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Violate any laws or regulations in your jurisdiction
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the platform or servers
• Use automated systems to access the platform without permission
• Share your account credentials with unauthorized parties

5. Service Usage Rules

5.1 Subscription Plans

Our platform operates on a subscription basis. You agree to:

• Pay all fees associated with your selected plan
• Adhere to the lead limits and features of your plan
• Upgrade your plan if you exceed your limits
• Maintain active payment information

5.2 Data Ownership

You retain all ownership rights to your data. We act as a data processor and will process your data only in accordance with your instructions and our Privacy Policy. You grant us a license to use your data solely for the purpose of providing our services.

6. Payment Terms

6.1 Fees and Billing

Subscription fees are billed in advance on a monthly or annual basis, as selected. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6.2 Payment Methods

We accept payment through credit cards, debit cards, net banking, and UPI. You agree to provide current, complete, and accurate purchase and account information for all purchases.

6.3 Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the service after the price change constitutes acceptance of the new pricing.

7. Refund Policy

Free Trial: We offer a free trial period for new users. You may cancel at any time during the trial period without charge.

Subscription Refunds: Monthly and annual subscription fees are generally non-refundable. However, we may provide refunds in the following circumstances:

• Service cancellation within 7 days of initial subscription
• Service outages or failures that prevent platform usage
• Billing errors on our part
• As required by applicable consumer protection laws

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDUCATION CRM PLATFORM AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

9. Termination

9.1 Termination by You

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent or illegal activities.

9.3 Effect of Termination

Upon termination, your right to use the platform will immediately cease. We may delete your account and data after a reasonable retention period, subject to our data retention policies and legal obligations.

10. Intellectual Property

The platform, including all content, features, functionality, and software, is owned by Lead101 and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your internal business purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our services.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Karnataka, India.
